90 day trial periods

Some recent ERA decisions have shown that the 90 day trial period does not mean you can throw caution to the wind and disregard all due process. Some unjustified dismissal claims are still upheld, so its worth remembering these points:
- ensure the dates of the trial period are clearly specified in the employment agreement
- ensure the employee signs the agreement containing the clause prior to their first minute of work (not at
- morning smoko!)
- ensure you don’t allow them to do any other form of paid work trial prior to commencing employment, unless you can guarantee this was part of the recruitment process
When in doubt, follow the same process you would post-90 day trial and that way, at least you have covered all bases!
